We: HR Today (EQ Consultants Ltd) (Company)
You: Any entity engaging HR Today services (Client)
HR Today provides a range of Human Resource services to our client organisations via a Service Portal and Email/Telephone support and a document library.
These Terms and Conditions apply to HR Today services and are subject to variation from time to time.
These Terms and Conditions comprise all the terms, representations and warranties between the parties and supersede all prior discussions and agreements covering the subject matter of this agreement.
All implied terms, conditions or warranties are excluded from this contract to the fullest extent permitted by the law.
All representations, warranties or commitments made by a Company agent or representative must be first authorised in writing by a manager or person of authority in the Company. The Company shall not be bound by any unauthorised
statement.
The minimum term for HR Today services is twelve (12) months.
60 days is required to terminate this agreement, at the end of the initial 12-month term.
HR Today will provide the following services as part of the monthly fee. These services are available to you via the Service Portal or email/telephone:
- HR Compliance Audit (Online HR Health Check)
- HR Skills (HR training material)
- HR Docs (Document and template library, including process guides)
- HR Hotline (email or telephone support for HR-related issues)
- HR Webinar (Live and recorded)
- The agreed rates and fees will remain in place for the contract term. In addition to the agreed charges, you will pay GST and any other relevant taxes which relate to any service.
- If you are paying HR Today via Credit Card you agree to pay for our Services from the financial information you have supplied to us. You authorise us to withdraw funds on this card immediately and each month without further reference to you. You will receive a receipt for all payments made.
- Payments are paid in advance at the beginning of each month.
- Payments are non-refundable unless otherwise agreed at our sole discretion.
- Our monthly fee is based on the number of employees (permanent full-time, part-time) in your organisation. On the anniversary of this agreement, you will be sent a request from HR Today to update your headcount numbers (increase or decrease). We will adjust the monthly fee accordingly.
- 1 – 5 Employees - $249.00
- 6 + Employees - $249.00 + $18.00 for every additional employee
- We may suspend our Service and remove access to our Service Portal immediately if payment is outstanding and only return such access when correct payment is made.
- The cost of recovering any debt owed to us shall be met by you.
- We will do our best to maintain our Service Portal so that you have constant use, but there will be times when your use may be interrupted. Interruption for reasonable periods for maintenance or causes beyond our control is not grounds for repayment of money you have paid. When we are aware of the likelihood of down-time, we will tell you in advance.
- Our HR Helpdesk services will be provided over the telephone, by email or Zoom. There is no monthly usage cap on the HR Helpdesk support, but from time to time we will recommend an onsite consultation as the only practical way to assist you to resolve complex HR challenges. Should this occur additional charges will apply at the agreed preferential hourly rate plus any additional costs that are incurred.
- Our offer of 'Unlimited' helpdesk support is based on both parties being 'Fair and Reasonable' in respect of this offer. If EQ Consultants, in their own discretion, believes that if the amount of support requested from the Helpdesk is unreasonable we will advise you accordingly and make a recommendation on how to remedy.
- You may not allow other organisations to access our Service Portal using your login details.
- If we believe you have breached these Terms and Conditions, we may suspend your account and cease all Services. We will then seek information from you about the potential breach and in some circumstances, we may decide additional charges are necessary to restore your account status. We will discuss these with you to gain your agreement. However, failure to reach an agreement may result in your account being terminated and no refund is payable to you.
All financial transactions are handled by a reputable third-party secure site and HR Today has no access to this information.
The total liability (including interest and costs) of HR Today (EQ Consultants Ltd which shall include any Director, employee or agent of EQ Consultants Limited) to you, whether in contract or tort, including negligence, resulting from all breaches of this service agreement, whether or not such defaults or breaches entitle you to terminate the agreement, shall be limited to $250.
Under no circumstances shall HR Today (EQ Consultants Limited) be liable to you for accidental, indirect, special, punitive or consequential damages whatsoever (including loss of profits) even if HR Today (EQ Consultants Limited) had or has been advised of, knew or should have known of the possibility of such loss or damage.
The following services and products do not form part of the HR Today monthly fee and will be charged separately at HR Today preferential rates.
- Onsite HR Consultation
- Recruitment Projects
- Psychometric Assessments
- Employee Surveys
- Training Workshops
- These Terms and Conditions are governed by New Zealand law.
- These Terms and Conditions are binding on and for the benefit of, the successors of the Client and the successors and assigns of the Company.
- The Client may not assign this agreement without the prior written consent of the Company.
Copyright Notice
This HR Today Document Section and all information in it are manufactured and distributed under licence by EQ Consultants Limited. You are granted a personal, non-transferable and non-exclusive licence to use the Section and all information in it. The Section and all information in it are protected by copyright.
You may use the Section and the information in it for business purposes within your organisation but you may not make the Section and any of the information in it available for use outside your organisation.
All intellectual and industrial property rights in the Section and the information in it are reserved. The owner and distributors do not provide any warranties in relation to the Section.

The owner and distributors have made every effort to ensure that the information contained in this Section is complete and accurate however no responsibility can be taken by the owner or distributors for any liability or action arising from any incomplete or inaccurate information.

Limitations to and exclusions of the liability of the owner and distributor are set out in your licence agreement with the owner or licensed distributor.
